Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Diabetic Vitamix Recipes iOS application and the website at diabetic.zainanjum.site (the “Service”), provided by Zain Ul Abideen (“we,” “us,” or “our”).
By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Diabetic Vitamix Recipes offers diabetes-friendly recipe discovery, meal planning tools, grocery lists, nutrition displays, optional personal tracking features (such as water, macros progress, or blood sugar notes), and related kitchen utilities on iPhone. Free sample content may be available; premium features may require a subscription.
The website at diabetic.zainanjum.site is a promotional and support presence for the iOS app. It is not a full recipe browser replacement for the app experience.
2. Eligibility & accounts
- You must be able to form a binding contract under applicable law and meet any minimum age required by the App Store in your region.
- You are responsible for maintaining the confidentiality of your account credentials and for activity under your account.
- Provide accurate information and promptly update it if it changes.
- You may request account deletion through in-app controls where available or by contacting support.
3. Health & nutrition disclaimer
Recipes, nutrition values, meal plans, tracker insights, and any blood sugar logging features are provided for general informational and educational purposes only.
- They are not medical advice, diagnosis, treatment, or a substitute for care from a licensed clinician or registered dietitian.
- Nutrition figures may be estimates and can vary by brand, portion, preparation, and substitutions.
- Diabetes management is highly individual. Always do your own research, read ingredient labels, and follow professional guidance before changing diet, medication, or care routines.
- Do not disregard professional medical advice because of something you read or see in the Service.
4. Premium features & billing
Some features require an auto-renewable subscription or other in-app purchase processed by Apple. Payment is charged to your Apple ID account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period, according to Apple’s terms. Manage or cancel in your Apple ID subscription settings.
Refunds, billing disputes, and payment method issues are handled by Apple under Apple’s policies. We may use partners such as RevenueCat to verify entitlements and unlock premium access.
5. Acceptable use
You agree not to:
- Misuse the Service, attempt unauthorized access, or interfere with servers, APIs, or other users
- Scrape, harvest, or systematically extract content beyond ordinary app use without permission
- Upload unlawful, abusive, infringing, or harmful content
- Reverse engineer the app except where such restriction is prohibited by law
- Use the Service for any purpose that violates applicable law
6. Intellectual property
The app, website, branding, design, text, graphics, and curated content are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. “Vitamix” and other third-party names may be trademarks of their respective owners; we are not affiliated with or endorsed by Vitamix unless explicitly stated.
7. Third-party services
The Service may link to or integrate third-party platforms (including Apple, advertising networks, analytics, and subscription tooling). Their terms and privacy policies apply to their services. We are not responsible for third-party content or practices.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not warrant that the Service will be uninterrupted, error-free, or that nutrition or tracking data will be accurate or complete.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the Service. Provisions that by their nature should survive (including disclaimers, limitations, and intellectual property) will survive termination.
11. Changes
We may update these Terms periodically. The “Last updated” date will change when we do. Continued use after changes become effective constitutes acceptance of the updated Terms. If you do not agree, discontinue use of the Service.
